Residence permit for an Employee (Zamestnanec)

TEMPORARY RESIDENCE FOR THE PURPOSE OF EMPLOYMENT MAY BE OBTAINED:

  • based on a Confirmation on the Possibility to Fill a Vacancy (also called Single Permit);
  • based on a work permit;
  • without the need to obtain a work permit and a Confirmation on the Possibility to Fill a Vacancy;
  • for seasonal employment or
  • within the intra-corporate transfer.

When submitting the application at the diplomatic mission, the foreign national will be interviewed for the purpose of a preliminary assessment of the application.

IT may be granted for the foreseen duration of employment, for a maximum period of 5 years. Before submitting the application, the employer must report a job vacancy to the competent Labour Office.

The Vacancy Announcement must be published at least 10 working days (in the case of a work permit) or at least 20 working days (in the case of a Confirmation on the Possibility to Fill a Vacancy) before submitting the application for temporary residence/work permit. The Vacancy Announcement is also required in cases when the Labour Office issues a Confirmation on the Possibility to Fill a Vacancy without assessing the situation in the labour market (mainly in the case of shortage professions). However, in such cases, it is possible to submit one’s application for a temporary residence immediately.

The Confirmation on the Possibility to Fill a Vacancy is required in most cases. Only in specific situations, it is required to apply for a work permit separately (e.g. in the case of employing a foreign national with a temporary residence for the purpose of family reunion within one year from its granting, or when he/she is employed as a sailor), or neither the Confirmation on the Possibility to Fill a Vacancy, or the work permit are required.

The condition for issuing a Confirmation on the Possibility to Fill a Vacancy or a work permit is full-time employment/part-time employment based on a contract of employment (agreements on work performed outside the employment relationship are not acceptable).

Temporary residence for the purpose of employment is not required for a period of up to 90 days from the beginning of residence in Slovakia, if the foreign national resides in the country legally and fulfilled the reporting duty towards the Foreign Police (within 3 working days from entering the territory of the Slovak Republic) and who:

  • works for a significant foreign investor;
  • is hired by an employer based in an EU Member State for the outsourced services;
  • is employed in international transportation company;
  • Is employed for a specified time for the purpose of training (internship) at a labour shortage position and submitted his/her application for a temporary residence for the purpose of employment together with all the required documents for the same job position;
  • For a maximum period of 90 days a year, or during a period determined by a decision on investment aid, secures delivery of goods or services based on a commercial contract and delivers such goods or services, or carries out installation works, warranty services and repairs, work related to system production facilities setup, programming work or professional trainings;
  • Performs seasonal work; or
  • For a maximum period of 90 days in a calendar year provides professional trainings for the enterprise services Centre.

During the validity of temporary residence for the purpose of employment, it is possible to study without the need of further permits.

A 60-day protection period applies to the foreign national after cessation of employment, during which the Foreign Police will not cancel the residence and the foreign national may search for a different employment.

APPLICATION

When submitting the application at the diplomatic mission, the foreign national will be interviewed for the purpose of a preliminary assessment of the application.

The application must be submitted in person on the official form and in Slovak language. If the foreign national is applying for the Single Permit (temporary residence for the purpose of employment based on the Confirmation on the Possibility to Fill a vacant Job), the application will not be accepted without a valid travel document (other documents may be submitted later, however submitting them may not be avoided). In other cases, the application must be submitted together with all the following documents:

  1. Valid passport (travel document);
  2. Two colour photographs (3 X 3.5 cm);
  3. Document on purpose of residence:
  • In case of the Single Permit (temporary residence for the purpose of employment based on the Confirmation on the Possibility to Fill a vacant Job): Contract of employment or the employer’s Commitment to hire the foreign national and the decision to recognize foreigner’s education (must be officially apostilled or legalized), or
  • In other cases: work permit, the employer’s confirmation that a work permit is not required, or an International Agreement.
  1. Criminal record statement from the country of the foreign national’s citizenship and the countries where he/she resided for more than 90 days during 6 consecutive months in the last 3 years (does not apply in the case of residence type/purpose of stay change);
  2. Document on accommodation in Slovakia for a minimum period of 6 months, or for the entire stay when applying for temporary residence for a shorter time:
  • Affidavit of the foreign national about ownership of a Slovakian real estate property;
  • Notarized lease contract (in which the applicant is indicated as the tenant/one of the tenants; both signatures of the landlord and the tenant must be notarized);
  • Notarized affidavit of the property owner to provide the foreign national with accommodation (the affidavit must include notarized signatures of all property owners); or
  • Confirmation from an accommodation facility (hotel, dormitory) on the provision of accommodation.
  • If the foreign national concludes a lease contract with the holder of the property (not its owner), or if the affidavit is provided by the holder of the property, it is also required to submit a document proving the entitlement to use the property (contract between the owner and holder).
  1. Document on financial coverage of residence confirming the amount of defined life minimum for each month of residence (until 30. 6. 2020, the defined life minimum is EUR 210.20/month); if the planned residence exceeds 1 year, document should confirm the amount of doubled defined life minimum (i.e. EUR 2 522.40);
  • the employer’s confirmation on the agreed salary, or
  • an applicant’s bank account balance confirmation;
  1. Administrative fee EUR 165.50 (when submitting the application at the Foreign Police Department) / EUR 170 (when submitting the application at the diplomatic mission of the SR abroad);
  2. Administrative fee EUR 4.50 (for issuing a residence card).
